- Product Descriptions: We strive to accurately display the features, descriptions, colors, details, and prices of our products, such as “Premium durable resistance bands” or our “BEST SELLING…Top-rated durable fitness gear.” However, we do not guarantee that all product descriptions, photographs, or other content are entirely accurate, complete, reliable, or error-free. If a product offered on our Site is not as described, your sole remedy is to return it in unused condition pursuant to our Refund and Returns Policy.
- Availability: All products are subject to availability. We reserve the right to discontinue any product at any time. In the event a product is out of stock after you place an order, we will notify you promptly and offer a substitute, backorder with an estimated timeline, or a full refund for that item.
- Pricing and Errors: We reserve the right to correct any pricing errors on the Website, even after an order has been submitted. If an order is placed at an incorrect price due to an error, we may cancel the order or contact you for instructions before processing. All prices are listed in Euros (€) and include Croatian Value Added Tax (VAT) where applicable. Prices do not include shipping costs, which will be added at checkout, unless you qualify for our Fast Free Shipping on orders over 50€ within the EU.
- Order Acceptance: Your placement of an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason at our sole discretion, including but not limited to: product unavailability, errors in product or pricing information, suspicion of fraudulent activity, or inability to authorize your payment.
3. Payment Terms
- Payment Methods: We accept major credit/debit cards and other secure payment gateways as displayed at checkout. By submitting payment information, you represent that you are authorized to use the payment method.
- Payment Authorization: You authorize us to charge your chosen payment method for the total amount of your order (including taxes and shipping) at the time your order is placed. If your payment cannot be processed, your order will not be fulfilled.
- Sales Tax: For customers within the European Union, prices include VAT. For international customers outside the EU, you are responsible for any and all customs duties, import taxes, and fees levied by your country, as outlined in our Shipping Policy.
4. Shipping, Delivery, and Title
- Shipping Policy: All orders are subject to our Shipping Policy. Please review it for detailed information on processing times, shipping areas, methods, costs (including our Fast Free Shipping offer for EU orders over €50), and delivery estimates.
- Delivery & Risk of Loss: We will arrange for shipment of the products to the delivery address you specify. Title to the physical products and risk of loss passes to you upon our delivery of the items to the carrier (e.g., Croatian Post or our partnered courier service). We are not liable for delays caused by the shipping carrier, customs, or events beyond our reasonable control (force majeure).
- Address Accuracy: It is your responsibility to provide a complete and accurate shipping address. We are not responsible for orders lost or delayed due to incorrect addresses provided by you.
5. Returns, Refunds, and Exchanges
- General Policy: All returns, refunds, and exchanges are governed strictly by our Refund and Returns Policy. You must review and comply with its terms to be eligible for a return.
- Key Condition – No “Refund Only”: We emphasize that we do NOT offer “Refund Only” (where the customer keeps the item and receives a refund). A refund is issued only after the product has been returned to us, inspected, and approved as meeting all return conditions (unused, in original packaging, within 30 days, etc.).
- Defective/Damaged Items: If you receive a defective, damaged, or incorrect item, please contact our super knowledgeable and patient customer service team immediately at brewsky@kondicijashop.com within 7 days of delivery for resolution, which may include a replacement or full refund including return shipping costs.
6. Intellectual Property Rights
- Ownership: The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof, as well as our brand name “Kondicija,” logos, and slogans like “Train Hard. Stay Strong. Build Your Best Body”) are owned by Kondicija j.d.o.o., its licensors, or other providers and are protected by copyright, trademark, and other intellectual property laws.
- Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Website for personal, non-commercial purposes in accordance with these Terms.
